Who needs AB‑38 disclosure?
Sales of residential property in State Responsibility Areas or Very High Fire Hazard Severity Zones require defensible space disclosure under California law.
When is the inspection needed?
Documentation must be provided to the buyer at time of sale. We recommend completing inspection 30–60 days before listing to allow time for any needed work.
What does inspection typically cost?
CAL FIRE inspections are free but may have wait times. Private inspectors charge $200–500. Defensible space work varies based on property size and current conditions.
Can the buyer complete work after closing?
If documentation isn't available at closing, seller and buyer can agree for the buyer to obtain documentation after close, typically within 30–180 days.
What if we fail the initial inspection?
We complete required work and schedule re‑inspection. Most properties pass after addressing specific items noted in the initial report.
Do TICs have different requirements?
Tenancy‑in‑common properties may need coordination among all owners for shared defensible space areas. We help navigate these situations.
How long is compliance valid?
Documentation is typically valid for one year from inspection date, though some jurisdictions may have different requirements.
What about neighbor's vegetation?
You're responsible for your property only. If neighbor's vegetation creates hazards, document it but it won't prevent your compliance.
